Refund & Warranty .Policy

1. Overview
nash. (a trading division of Nash Imports, hereinafter “nash.”, “we”, “us” or “our”) operates a curated, sourced-on-demand model for premium boxed & sealed Grade-A preowned and new electronic devices. This policy sets out your rights and our obligations in respect of refunds, returns, exchanges, and warranty support in accordance with the South African Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), and applicable common law.
By placing an order with nash., you acknowledge that you have read, understood, and accepted the terms of this policy in full.
2. International Sourcing Window (7 – 14 business days)
Because nash. sources devices directly from verified international suppliers in Shenzhen and Hong Kong on a per-order basis, most orders require a standard sourcing window of 7 to 14 business days from the date of confirmed payment to the date of delivery within South Africa. This window covers procurement, quality control inspection, international freight, customs clearance, and final domestic courier dispatch.
In accordance with Regulation 44 of the CPA and Section 46 of the ECTA, where delivery cannot be effected within the disclosed sourcing window, you are entitled to:
- Cancel the order and receive a full refund of amounts paid; or
- Agree in writing to an extended delivery timeline proposed by nash.
Delays caused by force majeure events, customs inspection holds, courier network disruptions, or supplier stock verification issues will be communicated to you in writing (email or WhatsApp) as soon as reasonably practicable, and will not, on their own, constitute a breach of contract.
3. Cooling-Off Right (Section 44, ECTA)
As all nash. transactions are concluded electronically, you are entitled to a statutory cooling-off period of seven (7) calendar days from the date of delivery, during which you may cancel the transaction without reason or penalty, provided that:
- The device is returned in its original, sealed, unused condition with all packaging, accessories, documentation, seals and serial-number stickers intact;
- The device has not been activated, paired to an account (Apple ID, Google, Samsung, etc.), or had any personal data written to it;
- You bear the direct cost of returning the device to nash.
Refunds under the cooling-off right will be processed within thirty (30) days of receipt and inspection of the returned device.
4. Implied Warranty of Quality (Section 56, CPA)
Every device supplied by nash. carries the six-month implied warranty of quality prescribed by Section 56 of the CPA. Within six (6) months of delivery, if a device fails to satisfy the requirements and standards of Section 55 of the CPA (i.e. it is not of good quality, in good working order, free of defects, useable and durable for a reasonable period, or does not comply with any applicable standards), you may return it and elect, at your sole discretion, to receive:
- A full refund of the purchase price paid; or
- A replacement device of equivalent make, model, storage and condition; or
- A repair of the device at nash.'s cost.
5. Limited Hardware Warranty & Accessory Specifications
For permanent catalog listings, nash. provides a six (6) month limited hardware warranty from the date of delivery. All catalog devices are securely packaged with premium, high-quality compatible boxes and certified charging accessories (which are fully functional but may not be original manufacturer assets). Battery capacity across catalog devices is guaranteed at greater than or equal to 80% (≥80%), with legacy models (iPhone 6 to 8 Plus, X to XS Max) pre-fitted with brand-new internal batteries. Liquid ingress or moisture damage of any volume is strictly excluded, as original manufacturer waterproof structural seals cannot be guaranteed on refurbished devices.
6. Return Procedure
- Contact nash. via the contact page or the WhatsApp number provided in your order confirmation, quoting your order reference number (e.g. #10001).
- A Return Merchandise Authorisation (RMA) will be issued in writing, together with return shipping instructions to our Cape Town intake facility.
- Package the device securely in its original box with all accessories and documentation, and ship using a tracked courier of your choice.
- Upon receipt, our technicians will conduct a diagnostic inspection within five (5) business days and communicate the outcome.
- Approved refunds are paid to the original payment method within ten (10) business days of approval.
7. Direct Refunds & Method of Payment
All refunds are processed exclusively to the original method of payment used at checkout. Cash refunds and refunds to third-party accounts are not permitted. Where the original payment method has expired, been closed, or is otherwise unavailable, the refund will be processed by EFT to a South African bank account held in the customer's own verified name.
8. Custom Sourcing Restrictions & Non-Returnable Items
Bespoke, custom-configured sourcing requests executed via external electronic secondary market platforms (including but not limited to items sourced via client specification outside permanent catalog infrastructure) are strictly final. Once procurement has commenced with international secondary handlers, these orders cannot be cancelled, returned for a change of mind, or refunded. Because secondary market platforms do not extend rolling commercial cover, custom-sourced items are explicitly excluded from the standard nash. extended warranty matrix and are accepted at the buyer's sole risk, save for statutory protections regarding material defects present strictly at the exact moment of initial unboxing.
9. Contact & Complaints Escalation
All returns, warranty claims, and complaints must be directed in writing to nash. first, via the contact page. In the unlikely event a matter cannot be resolved, you are entitled to refer the dispute to the National Consumer Commission or the Consumer Goods and Services Ombud (www.cgso.org.za).
