Terms of .Service

These Terms of Service (“Terms”) constitute a binding legal agreement between you (“Customer”, “you” or “your”) and nash., a trading division of Nash Imports (“nash.”, “we”, “us” or “our”), a business duly registered in the Republic of South Africa.

By accessing our website, browsing our catalogue, submitting a sourcing request, placing an order, or otherwise engaging with any nash. service, you acknowledge that you have read, understood, and irrevocably accept these Terms and our Refund & Warranty Policy.

You must be at least 18 years of age (or the legal age of majority in your jurisdiction) and have the full legal capacity to enter into a binding contract in order to place an order with nash. By ordering, you warrant that all information provided — including your identity number, contact details and delivery address — is true, accurate and complete.

nash. operates a curated, sourced-on-demand model. Devices displayed on our catalogue are indicative of what we can procure through our verified international supplier network in Shenzhen and Hong Kong. Placement of an order constitutes an authorisation for nash. to procure the specified device on your behalf, subject to stock verification and quality control inspection.

The standard sourcing and delivery window is 7 to 14 business days from the date of confirmed payment. Full details are contained in our Refund & Warranty Policy.

All prices are quoted in South African Rand (ZAR) and are inclusive of Value-Added Tax (VAT) where applicable. Prices are subject to change without notice, but the price applicable to your order is the price displayed at the time of order confirmation.

Payment is required in full prior to procurement. nash. accepts electronic payment via approved payment gateways, including but not limited to Bob Pay. All payments are processed by the applicable payment provider under their terms; nash. does not store full payment card details on its systems.

An order is only deemed accepted once nash. has issued a written order confirmation containing a unique reference number (e.g. #10001). nash. reserves the right to decline or cancel any order at its sole discretion, including where fraud, pricing error, or supply unavailability is suspected, in which case any amounts already paid will be refunded in full.

Domestic delivery within the Republic of South Africa is facilitated by third-party couriers, including The Courier Guy. A flat delivery charge of R100 applies to all standard orders unless otherwise indicated.

Risk of loss and damage passes to you upon signed delivery at the address you nominated. Ownership passes upon full receipt of cleared funds by nash. and delivery of the device.

To comply with our internal anti-fraud policy and applicable anti-money-laundering legislation, nash. may require you to submit a valid South African identity number or passport number at checkout. This information is stored securely, encrypted at rest, and displayed to authorised personnel only in a masked format.

Grade-A preowned devices are boxed & sealed, factory refurbished units that have passed multi-point quality control inspection. Cosmetic condition is guaranteed as “as-new” unless otherwise disclosed on the product page. Statutory and extended warranty terms are set out in our Refund & Warranty Policy.

You agree not to:

• Use the nash. platform for any unlawful, fraudulent or abusive purpose;
• Attempt to gain unauthorised access to any portion of our systems or backend;
• Reverse engineer, scrape, or otherwise extract our catalogue data for competing commercial use;
• Impersonate any person or misrepresent your identity, affiliation or intent.

All content on the nash. platform — including trademarks, logos, product photography, copywriting, layouts and code — is the intellectual property of Nash Imports or its licensors and is protected by South African and international law. No portion may be copied, reproduced, republished, or otherwise exploited without our prior written consent.

To the maximum extent permitted by law, nash. shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with the use of our platform or the supply of any device. nash.'s aggregate liability in respect of any single order shall in no event exceed the amount actually paid by you for that order.

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under the CPA or other applicable law.

nash. processes your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). We collect only the information reasonably required to procure, deliver and support your order, and we retain it for no longer than is necessary. Personal information is never sold to third parties.

Neither party shall be liable for any failure or delay in performing its obligations where such failure or delay results from any cause beyond that party's reasonable control, including acts of God, war, pandemic, government action, customs delays, courier disruption, or internet or telecommunications outage.

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. The parties consent to the non-exclusive jurisdiction of the Magistrate's Court having jurisdiction, notwithstanding that any claim may exceed its monetary jurisdiction.

nash. reserves the right to amend these Terms at any time. The most current version will always be published on this page and will apply from the date of publication. Continued use of the platform after such amendment constitutes acceptance of the revised Terms.
